Tamil Nadu Waqf Board is a statutory body established under the Waqf Act 1954 that supervises and manages Waqf institutions and administers Waqf properties.

Waqf properties are those movable and immovable properties, dedicated by a person professing Islam, for any purpose recognized by the Muslim law as pious, religious, or charitable.

A shocking case of the Waqf Board encroaching on a property has come to light in Tamil Nadu, where an entire village with a Hindu majority population has been declared as waqf property. Thiruchenthurai village near Trichy, Tamil Nadu has been designated as a waqf property by the Tamil Nadu Waqf Board. Thiruchenthurai is a village situated on the south bank of the Cauvery river in Tamil Nadu.

The issue was uncovered when a person named Rajagopal attempted to sell his 1 acre 2 cents of land to one Rajarajeshwari. When Rajagopal, a resident of the nearby village Mullikarupur village arrived at the Registrar’s office to get the sale of his land registered, he was surprised to learn that the land did not belong to him and instead belonged to the Waqf Board.

“The Waqf Board owns the land on which you have come to register the deed. This contract cannot be registered, according to the Waqf Board’s directive,” Murali, the registrar, stated. “You should obtain a no-obligation certificate from the Waqf Board in Chennai,” he further added. “Why do I need to obtain a no-obligation certificate from the Waqf Board to sell my land which I purchased in 1992?” Rajagopal inquired in astonishment.

Showing a 250-page letter from Tamil Nadu Waqf Board to Rajagopal, the registrar said that any sale of land in Tiruchenthurai village requires a no-objection certificate from the Waqf Board in Chennai. “The Waqf Board has informed the Deeds Department by letter and documentation that the entire village is theirs. It has also been stated that individuals who come to register a deed for land in the village should obtain a certificate of no objection from them,” he elaborated.

When Rajagopal narrated the incident to the villagers, the entire villagers were shocked to learn that their land is not theirs. They wondered how Waqf Board can claim ownership of the entire village when the villagers have all the necessary land documents for their respective lands, both residential and agricultural.

When this subject was brought to the District Collector’s attention by the villagers, he stated that the matter will be investigated and action will be taken after that.

BJP leader from Trichy Allur Prakash had noted that the Thiruchendurai village is a picturesque agricultural village located on the south bank of the Cauvery River where a large majority of the people are Hindus. “What is the relationship between the Waqf Board and Thiruchenthurai Village?”, he was quoted as saying in the report.

“There is the Manendiyavalli Sametha Chandrasekhara Swamy temple, which has a ‘paadal petra sthalam. Various documents and evidence suggest that this temple is 1,500 years old. The temple owns 369 acres of land in both inside and outside Tiruchenthurai village. Does this temple land also belong to the Waqf Board?” Prakash was quoted as saying.

It is believed that Lord Renganathar of the Srirangam Temple wakes up in Tiruchenthurai village during the Adibrahmotsava festival of Panguni month.

“When an individual of the village holds the land documents, how can the Waqf Board declare it to be its property without any evidence? Even if the Waqf Board has issued a letter claiming the lands to be its own, how can the higher officials of the Registration Department order not to register the deed without verifying the claims of the Waqf Board?”

Days after news surfaced that the Waqf Board had encroached on an entire hamlet with a Hindu majority population in Tamil Nadu, Times Now has learned that this village is not the only one. The report suggests that the Tamil Nadu Waqf board has claimed ownership of 7 such Hindu villages in the state. The villagers have additionally, alleged that the Waqf Board has also claimed that the 1500-year-old Sundareswarar Temple belongs to them.

Notably, the Waqf Board has placed posters across the villages claiming ownership of the village land.

Meanwhile, to refute the Waqf Board’s assertions, the locals displayed documents proving that the land had been in their family for centuries. The villagers were taken aback by the Islamic board’s claim to ownership of a centuries-old temple. They have urged the Tamil Nadu Chief Minister to intervene and assist them in stopping the Waqf Board from wrongfully snatching their property.

Jyothilakshmi, a Hindu woman living in one of the hamlets encroached by the Waqf Board reportedly told Tomes Now, “where will we go? This has come as a shock to me. I am getting palpitations and I had to go to the hospital.”

The Tamil Nadu Government Registration Department official on their part have said that there are encroachments on water bodies, Waqf Board properties, and temple properties. The department claims to have received information that through forged documents, unrelated persons were holding these lands with many embroiled in legal disputes.

“The court criticized the government on the issue and directed to take appropriate steps to recover the assets. Based on that, in 2016, the government took measures to recover the assets. Following this, the Waqf Boards stepped in to recover their properties all over Tamil Nadu. It has sorted out what it found to be its assets and notified to the department. It has also asked the registration department to stop any arrangement for the registration of deeds in respect of certain properties. It is on this basis that entire villages including Thiruchendurai and Kadiakurichi have been identified as Waqf Board properties.”, Registration Department officials were quoted as saying in the report.

Officials also noted that they will be speaking to the Secretary of the Minority Welfare Department and the Chairman of the Waqf Board.

They admitted that it is absurd to refer to Thiruchendurai temple and the lands belonging to it as Waqf Board properties and that they have been facing problems when deed registrations have to be denied on the basis of Waqf Board’s letter.

Apart from villages like Thiruchenthurai and Kadiakurichi, regions in and around Chennai also have this problem where lands have been claimed by the Waqf Board.
